Motor Accident and CTP Claims by State
There is no single Australian CTP claim process. The place of the crash, vehicle registration, fault, work travel and injury can change the pathway.
Identify the scheme
NSW uses SIRA-regulated CTP insurers, Victoria uses the TAC, Queensland claims usually proceed against a licensed CTP insurer under MAIC rules, and WA motor injury insurance is administered by ICWA.
Preserve crash and injury evidence
Keep vehicle details, police reporting, witnesses, photographs, dash-camera footage, transport or rideshare records, clinical evidence and income information.
Separate statutory benefits from damages
Treatment, weekly or income benefits and common-law damages can have different eligibility, fault, impairment and timing rules. Ask which stage a proposed legal service covers.
Check work-related travel
A crash in the course of employment may engage workers compensation as well as the motor scheme. Notify the employer and ask which claim should be made first.
