An adverse result is not itself proof of medical negligence. Assessment usually separates the professional standard, what should have occurred, whether any departure caused a different outcome, and the loss attributable to that outcome under the relevant jurisdiction's law.
Identify the claim pathway
Record the providers, consultations, tests, diagnoses, consent discussions, medication, procedures, discharge advice and later treatment. Obtain appropriate ongoing care first, then ask which jurisdiction, defendant and limitation framework may apply.
Preserve useful evidence
Request information from the provider that holds it. My Health Record can contain useful summaries but may not be the complete clinical file. Keep imaging, pathology, referrals, correspondence, expenses, work impact and a neutral chronology.
Compare the proposed legal service
Ask which expert specialty may be relevant, what records are required, who funds report fees and when prospects will be reassessed. Compare the responsible lawyer, medical-negligence experience, causation approach, communication, disbursements and full costs agreement.
