An injury on premises does not automatically make an occupier, retailer, council or owner liable. The investigation asks who controlled the location, what risk existed, whether it was foreseeable, what precautions were reasonable, and whether the condition caused the loss.
Identify the claim pathway
Identify the precise aisle, path, stair, car park, venue or boundary and the entities controlling it. Councils, public schools and government bodies may have statutory protections or procedures; dog bites and defective equipment can add another pathway.
Preserve useful evidence
Take wide and close photographs, keep receipts and incident references, collect witness details and request relevant CCTV preservation. Keep footwear or failed equipment in its post-incident condition where safe. Weather, inspection, cleaning and maintenance records may matter.
Compare the proposed legal service
Ask how the firm will identify the correct respondent, preserve evidence, investigate control and knowledge, and assess causation. Compare experience with the relevant jurisdiction, public-body rules, expert needs, litigation risk and cost terms.
