Workers compensation is administered through state, territory and Commonwealth systems. Forms, capacity certificates, insurers, benefits, rehabilitation duties and common-law rights differ. Employee, contractor, volunteer and public-sector status can affect the starting point.
Identify the claim pathway
Notify the employer, identify the legal employer and scheme insurer, and use the current certificate and claim documents. A host business, labour-hire arrangement, defective equipment or road incident can create a separate third-party pathway.
Preserve useful evidence
Keep the incident report, capacity certificates, claim correspondence, rosters, wage records, role description, site and induction material, photographs, witnesses and rehabilitation communications. Preserve records lawfully and do not remove confidential workplace material you are not entitled to keep.
Compare the proposed legal service
Clarify whether the firm handles the initial claim, weekly payments, treatment disputes, impairment, return-to-work issues, review proceedings and common-law damages. Ask what medical evidence is proposed and who approves its cost.
